BIZA HOUSING COMPANY General Rental Conditions
When booking an accommodation, the following General Conditions shall come into effect an govern the Rental Contract for a Seasonal Accommodation signed between You and the property, through IBIZA HOUSING COMPANY (hereinafter IHC):
First of all: Reservation and Contracting
In order to carry out a reservation you may fill in and email the IHC Reservation Voucher.
So that your reservation becomes valid you must pay a deposit of 50% of the total amount of the rental plus the Eco tax amount, and 30 € corresponding to management fees within 3 days
If payment of 50% has not been made on due date, IHC reserves the right to cancel your reservation without prior notice. The client shall then not be entitled to claim for or demand the fulfilment of the reservation.
The balance of the rental must be paid at least 30 days before the date of your arrival. Upon receipt of all payments, the customer will receive his rental contract with the necessary information on the day of his arrival
Your signature on the Reservation Voucher or, in its absence, the payment on account of 50% of the rental price unreservedly entails the acceptance and understanding,
of the IHC General Conditions.
Payments can be made by bank transfer. We accept payments by credit card (Visa or Master Card), in this case a fee of 2% for bank charges will be applied on the amount and charged to the client.
Secondly: Prices and Services
Prices indicated for accommodation are WEEKLY RENTAL PRICES. These prices include all the expenses attached to the use of the property (VAT is included exclusively for the mediation service of the rental contract): usual consumption of water, gas, electricity, household items (except beach towels) and maintenance service for the swimming- pool, gardens and other facilities, if available.
The rental price does not include phone or heating (indoor or of the swimming-pool, if necessary) consumption.

IHC will collect on behalf of the owner, the amount of 1 euro per person (x number of occupants provided for in the contract) and per day under for Eco tax
Thirdly: The Deposit
A security deposit shall be handed over on the day of arrival at the house so that the Client may take responsibility for non-fulfilment of the General Conditions hereby established as well as for any possible damages (of any nature whatsoever) incurred by the Client to the rented property. Non-payment of the deposit entitles IHC to refuse the Client access to the property and may lead to cancellation of the rental contract and loss of the sum paid.
The deposit will be fully refund to the client by bank transfer after checking that the house has not suffered any damage. In order to do this property IHC reserves 7 days from the end of the contract so that all the necessary verifications can be carried out.
Fourthly: Contract Cancellation by the Client
The Client has the legal authority to cancel the Reservation. Any such cancellation must be communicated by way of a written advice sent to IHC as registered post with acknowledgement of receipt. The date of receipt of that letter by IHC will determine the following cancellation penalties:
a) Up to 45 days prior to the date of arrival, the penalty will correspond to 50% of the full rental price.
b) If the cancellation occurs between 30 and 45 days prior to the date of arrival the penalty will correspond to 70% of the full rental price.
c) Cancellation less than 29 days prior to the date of arrival will result in the payment of 100% of the full rental price.
Fifthly: Client's Obligations
The number of persons who may occupy the house may never exceed the number which is stipulated in the contract; children and babies are also counted as persons. In the event of a greater number of persons, IHC may either prevent the Clients from having access to the property, without the latter retaining any right to claim a compensation, or increase the rental rate in accordance with the price per person per day of the rented property.
The Tenant shall respect the normal standards of cohabitation among neighbours and the Municipal Ordinances currently in force. The organization of parties without the relevant Municipal Licence is not allowed in Ibiza. In case of negligence or inappropriate behaviour, IHC reserves the right to cancel the Rental Contract with immediate effect and without prior advice, which might lead to full loss of the Deposit and the rent amounts already paid by the Client.
Pets will only be admitted in the rented property as long as permission has been sought previously and admission has been confirmed in writing.
Sixthly: Responsibilities attributable to IHC
If, for unforeseen reasons not attributable to IHC, the property cannot be occupied, IHC will inform the Client as soon as possible and provide them with an alternative solution, i.e. another accommodation of equal or superior characteristics. Should this option not be possible or the change not be accepted, the reservation will be cancelled and the amounts paid will be immediately returned, no additional responsibility being attributable to IHC.
Seventhly: Incidents and claims
Any incident or complaint concerning the rented property shall be communicated by telephone within 48 hours of the Client's arrival. IHC will try to solve the problem as soon as possible.
If despite all this the problem has not been solved to the Clients' complete satisfaction, they shall notify such by written advice and send email to IHC during the first four days of their stay. Once this period has elapsed, no complaint shall be considered as lodged.
IHC is at your disposal during your whole stay in order to solve all the little matters and to help you enjoy a happy stay.
Eighthly: Maintenance and conservation
The property is rented in perfect condition of use and conservation. The Client may not change the furniture or alter the decoration. The property must be given back in the same condition as it was found upon arrival, i.e., the house must be clean and tidy, without garbage, which must have been taken away by the Client. Disorder, dirt and household refuse shall be charged with a penalty of 150 Euros.
The client agrees not to rent the property unless written agreement of the owner and will be occupied by him and his family or any person that he wishes to host.
He may not engage in commercial activity there.
In case of non-return or loss of the keys, IHC will be obliged to deduct from the security deposit a minimum amount of € 200, locks change, and labour cost will be invoiced to the customer and deducted from the amount of the security.
Ninthly: arrival and departure
Clients should arrive at the rented property on the first day from 5.00 pm to 11pm. Departure on the last day is between 8.00 and 10.00 am.
For late ate check-in or check-out after 11pm IHC will charge 100 €.
If the Client cannot arrive on the expected day or time they are under an obligation to immediately notify IHC so that another day and time can be established for the key handing over.
The Client promises to vacate the property on the established date having previously and personally given the keys back to IHC, who will check the condition of the said property. Failing to do so may result in the loss of the Deposit.
In order to work out our arrival and departure plan, we kindly ask you to inform us about your scheduled arrival time as well as any eventual changes or alterations. Should you cut short or modify the conditions of your stay for whatever reason not attributable to IHC, you may not ask for any kind of refund.
Tenthly: Responsibility exoneration
IHC will not be held responsible in the following (expository but not limitative list) cases: a) Irregularities attributable to third parties in the supply of water, electricity, gas,
b) Nuisance or noises caused by works or occurrences, whether public or private,
outside the rented property.
c) Damages suffered by the persons or property at the swimming-pool, in the engine room, children´s play area or sports facilities, being all those potential damages strictly attributable to the Client.
The responsibility of IHC is limited to its mediation functions. Therefore IHC does not personally assume any responsibility whatsoever which corresponds to the owners of the properties.
Eleventh: Applicable legislation and jurisdiction
On making a reservation of accommodation the preceding General Conditions come into effect and will govern the Rental Contract of Seasonal Accommodation. All matters not covered by these Conditions shall be dealt with in accordance to the Spanish Law.
Both parties expressly resign their own jurisdiction and expressly agree to submit themselves to the jurisdiction and competence of the Courts of Ibiza in order to settle whatever matter which may arise from the application and interpretation of this contract.
